TMS Spot SMS Terms

Version 2026-10-04. Effective October 4, 2026.

These SMS Terms apply to text messages sent and received through TMS Spot, which is operated by LogixSpot LLC. They are part of the TMS Spot Terms of Service. Section A is for people who receive texts, such as truck drivers. Section B is for brokerages that send texts through TMS Spot.

A. For drivers and other message recipients

Program. TMS Spot driver tracking texts. A freight brokerage that uses TMS Spot (the "Sender") sends these texts about a load you are hauling. The text names the Sender and TMS Spot.

What you will get. Messages about one load at a time, such as a link to share your location and status for that load, pickup and delivery updates, check-call questions, and replies to messages you send. Messages are informational. They are never marketing.

How you agreed. You get these texts because you, your carrier or your dispatcher gave your mobile number to the Sender for this load. Sharing your location is separate: it only starts if you open the link and agree on that screen.

How often. Message frequency varies by load, usually a few messages per load. Messages for a load stop after the load is delivered or the tracking link expires.

Cost. Message and data rates may apply, according to your mobile plan.

Opt out. Reply STOP to any message to stop texts from that Sender. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT, or tell the Sender in another reasonable way. You will get one message confirming that you have opted out. To start again, reply START.

Help. Reply HELP for help, or email hello@tmsspot.com.

Carriers. Wireless carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed.

Privacy. See the TMS Spot Privacy Policy. We do not share or sell mobile phone numbers, text messaging opt-in data or consent records with third parties or affiliates for their marketing or promotional purposes.

Location. Location sharing is for the load only. It runs until the load is delivered or the link expires, pauses when the phone locks, and stops if you close the link, turn off location permission, or reply STOP.

B. For brokerages that send texts

If you send texts through TMS Spot, including through your own connected messaging account, you agree that:

  1. You are the sender. You are the sender of each message and are responsible for its content, recipients, timing and compliance with law, including the Telephone Consumer Protection Act and FCC rules, the Florida Telephone Solicitation Act and other state laws, CTIA guidelines, and your messaging provider's and wireless carriers' rules.
  2. Consent. You will text only mobile numbers for which you have the consent the law requires for that type of message, and you will keep records of that consent. Driver tracking texts must be about a specific load, sent to a driver hauling that load. You will not use TMS Spot to send marketing or promotional texts.
  3. Registration. If you connect your own messaging account, you are responsible for that account, its charges, and its registrations, including A2P 10DLC brand and campaign registration, and for keeping the registered use case accurate.
  4. Opt-outs. You will not text anyone who has opted out, and you will not change opt-out settings to get around an opt-out. TMS Spot processes STOP replies it receives automatically. You must also honor opt-outs you receive in other reasonable ways (for example, by phone or email) within the time the law requires, which is currently no more than 10 business days, by recording the opt-out in TMS Spot.
  5. Timing. You will avoid sending texts before 8 a.m. or after 9 p.m. in the recipient's local time, unless a message is needed for an active load and the recipient expects it.
  6. Content. Each message will identify you, will not contain prohibited content (such as content about cannabis, firearms, gambling or other categories your provider prohibits), and will not be misleading.
  7. Indemnity. You will defend and indemnify LogixSpot for claims arising from texts you send, as provided in the Terms of Service.

LogixSpot may block, throttle or stop messages, or turn off texting for a workspace, at any time to protect recipients or comply with law or provider rules.
