TMS Spot Acceptable Use Policy
Version 2026-10-04. Effective October 4, 2026.
This Acceptable Use Policy is part of the TMS Spot Terms of Service between you and LogixSpot LLC. It applies to every person who uses TMS Spot, including Authorized Users, customer and carrier portal users, and anyone who receives a driver tracking link. If you violate it, we may remove content, block messages, limit features, or suspend or close accounts, with or without notice.
1. Freight fraud and misrepresentation
Do not use TMS Spot to:
- impersonate another broker, carrier, shipper, dispatcher or driver, or use an MC number, DOT number, company name, email domain or phone number you are not authorized to use;
- double broker, re-broker or co-broker a load without the authorization the law and your contracts require;
- operate as a broker or freight forwarder without the FMCSA registration and financial security the law requires;
- issue false rate confirmations, bills of lading, proof of delivery, invoices, insurance certificates or other documents;
- commit cargo theft, payment fraud, factoring fraud, identity theft, phishing or any other fraud; or
- mislead shippers, carriers or drivers about who you are, the load, the rate or payment terms.
2. Illegal, harmful or infringing content
Do not upload, send or store content that:
- is illegal, or that you do not have the right to share;
- infringes or misappropriates anyone's intellectual property, privacy or publicity rights;
- is defamatory, harassing, threatening, hateful or discriminatory;
- contains malware, viruses or other harmful code; or
- arranges the transport of anything illegal, or of hazardous materials in violation of law.
3. Sensitive information
Do not put the following into TMS Spot unless a feature is specifically built to receive it: Social Security numbers; full driver's license, passport or other government ID numbers; bank account, financial account or payment card numbers; health, medical or health-insurance information; biometric data; or information about children. If you must store a document that contains this information (for example, a carrier packet), redact the sensitive numbers first when you can.
4. Messaging, calls and email
When you use TMS Spot to send emails, text messages or other communications, you must:
- have every consent the law requires before you text or call anyone, and keep records of that consent;
- send driver tracking and load texts only to drivers and contacts involved in that load, only for that load, and never for marketing;
- honor every STOP or other opt-out request, and never try to get around an opt-out;
- follow the TCPA, the Florida Telephone Solicitation Act and other state telemarketing laws, the CAN-SPAM Act, and wireless carrier and messaging provider rules, including A2P 10DLC registration for any messaging account you connect;
- not send unsolicited bulk email, spam, chain letters or deceptive subject lines or headers; and
- follow the SMS Terms.
5. Location tracking
Track a driver's location only for a load that driver is hauling, only after the driver has agreed in the tracking link, and only for as long as needed for that load. Do not use TMS Spot to track anyone covertly, to track anyone outside a load, or in violation of any law.
6. Security and integrity of the Service
Do not:
- access or try to access another workspace, account or data you are not authorized to access;
- probe, scan or test the vulnerability of the Service, or breach or bypass any security, authentication or rate limit, except in good-faith security research that you report to us promptly at hello@tmsspot.com, that avoids privacy violations, data destruction and service disruption, and that does not access other users' data;
- interfere with or overload the Service, including by denial-of-service attacks or excessive automated requests;
- scrape, crawl or harvest data from the Service, or use bots, except through an API or integration we provide;
- reverse engineer, decompile or try to extract the source code, models or prompts of the Service, except where the law expressly allows it;
- share your password or let someone else use your account, or create accounts by automated means or under false pretenses; or
- resell, sublicense, rent or provide the Service to third parties as a service bureau, other than to your own customers and carriers through the portals.
7. AI features
Do not use the Co-pilot or other AI features to:
- generate content that violates this Policy or the law;
- try to make the AI reveal other users' data, system prompts or secrets, or to bypass its safeguards (for example, prompt injection attacks);
- make automated decisions about people that have legal or similarly significant effects without human review; or
- run excessive or abusive workloads intended to use up shared capacity.
8. Competitive use
Do not use the Service to build or train a competing product, or to copy its features, design or content.
9. Reporting
Report violations or abuse to hello@tmsspot.com. We may investigate and cooperate with law enforcement.
